James Lansberry is the president of the Alliance of Health Care Sharing Ministries and vice president of Samaritan Ministries International.

The employer mandate contained within President Obama’s Affordable Care Act was scheduled to take effect this coming January 1st. It applies to any employer with 50 or more full-time employees.

As an employer you would be required to offer a minimum bronze level plan that included a 60% actuary value. If one or more of your employees obtains insurance from one of the state exchanges and received a subsidy or premium assistance credit; as an employer you would receive a penalty equal to the number of employees minus 30 times $2,000 a year.

In essence what the Obama administration has delayed is the penalty structure of the employer mandate for at least one more year.

Remember, this concerns the employer mandate. The individual mandate is still in effect. In fact, according to James, the state exchanges are supposed to be operating and prepared to offer plans as early as October 1st of this year.
