TX Heartbeat Law Stands

Recently a new anti-abortion law in Texas passed through the legislature, was  signed by the governor and was allowed to go into law by the U.S. Supreme Court.

Joining Jim to discuss this issue was Brad Mattes.  Brad is the president of Life Issues Institute, the pro-life grassroots partner of the Susan B. Anthony List Education Fund.  Life Issues Institute was founded in 1991 to serve the educational needs of the pro-life movement.  He’s the host of Life Issues, a daily radio commentary.

This new legislation is called the “Heartbeat Act”.  This act would stop any abortion once a medical professional can detect a heartbeat in the office of a doctor.  Brad noted that this is at the six week mark and certainly by 8 weeks.

Brad described how Texas legislators had seen last year how district attorneys across the nation were stating publicly that they would refuse to enforce pro-life laws if they passed.  So these legislators knew they needed to propose something that would usurp this dereliction of duty by DA’s nationwide.

The result is this new law that contains no criminal penalties.  Instead, the average citizen can file a civil lawsuit against anyone who violates the law.  This would include primarily the abortionist, the staff of the abortion center, anyone giving the woman a ride to the abortion facility, or someone who pressured or coerced her to have the abortion.  

If found guilty, such individuals would have to pay at least $10,000 plus court costs.  In this way, it’s hitting the abortion industry where it hurts them the most, in the pocketbook, while at the same time circumventing the normal process that the abortion industry would pursue to tie-up pro-life laws for many years.

Brad revealed that according to the Texas abortion industry, about 85-90% of abortions are done after six weeks.  This means that about 130-150 pre-born children per day will be saved in Texas by this new law.  

Will this cause a lawsuit “free-for-all”?  No, this is false because Brad indicated the law has been carefully crafted so that it can’t be abused.
