Mat Staver is the founder and president of Liberty Counsel, an international nonprofit litigation, education, and policy organization dedicated to advancing religious freedom, the sanctity of life, and the family.

Jim began by noting that yesterday the U.S. Senate was successful in obtaining the necessary 60 votes to stop a filibuster and invoke cloture to advance the nomination of Andrew David Hurwitz (the architect of Roe v. Wade) to the Ninth Circuit Court of Appeals.

This morning the Senate Committee on Health, Education, Labor and Pensions held a hearing on The Employment Non-Discrimination Act (E.N.D.A.—SB-811). E.N.D.A. would add new categories to the already existing non-discrimination categories. These additions include sexual orientation and gender identity. It would apply to a person’s actual or even their perceived sexual orientation or sexual identity.

Under this law, gender identity is defined as the gender related identity, appearance, mannerisms, or other gender related characteristics of an individual with or without regard to the individual’s designated sex at birth.

If this passes, can we expect rest room gender divisions to become blurred? Could protecting women and young girls in such situations cause a person to be in violation of E.N.D.A.? These are questions that Jim and Mat discuss as they not only look at E.N.D.A. but also Proposition 8 in California (one-man/one woman marriage), a vote regarding contempt of Congress charges against Attorney General Eric Holder, and the latest news concerning Obamacare.
